Tom Brennan Loses His Bank Charges Case
In conclusion to the case of Tom Brennan, who was taking NatWest to court for damages, after being charged “excessive†overdraft charges, we have to report that Mr Brennan has been unsuccessful in his bid. He has been the subject of a sustained campaign by lawyers representing NatWest, who have changed, cancelled and delayed the case from day one, in the hope that Mr Brennan would drop his claims. However, yesterday his case was thrown out of court with no right to appeal.
This marks the end of the road for a very personal campaign by Mr Brennan, who was looking to create a test case for others to use against their banks. There is some concern that he may be on the verge of losing everything if NatWest are awarded costs - although there has been no confirmation that this has happened. This would effectively bankrupt Mr Brennan, and stop him from continuing as a barrister.
It has been a very eventful few months for Mr Brennan, after receiving his overdraft charges in full and a near £2,000 payment for his hardship - without any admission of liability from the bank. Despite this set back the whole bank charges saga is far form over, with the Office of Fair Trading having recently agreed a test case with a number of high profile banks, which is due to go ahead very soon.
